\n TERMS AND CONDITIONS OF USE\n <\/h2>\n

\n These Terms of Use regulate the application called Workforce App  (hereinafter “the Application”). Workforce App  and Mapal are registered trademarks of the group of companies formed by the following companies: Mapal Software S.L, with registered office at C\/Arte, 21, planta 6, Madrid CP 28033 Spain. Flow Hospitality Training LTD with registered office at Apex 3, 2nd floor (Rear office), 95 Haymarket Terrace, Edinburgh, EH12 5HD United Kingdom. Ideolys SAS with registered office at 52 Rue Jacques-Yves Cousteau 8500 La Roche-sur-Yon France. GetCompliant 2013 AB with registered office at Hornsbruksgatan, 23b Stockholm 117 34 Sweden and Savvie AS with registered office at Myntgata 2D 0151 Oslo, Norway.\n <\/p>\n

\n \n ACCEPTANCE OF THE CONDITIONS\n <\/strong>\n <\/p>\n

\n Access to and use of the Application confers the condition of user (hereinafter, the ‘User’), who, by accessing and using the Application, expressly accepts the General Conditions of Use set out herein. Therefore, should you do not agree to these Conditions, please refrain from using it.\n <\/p>\n

\n \n OWNERSHIP AND PROTECTION OF CONTENT\n <\/strong>\n <\/p>\n

\n The above group of companies is the owner of all intellectual and industrial property rights of the Application, as well as of the elements contained therein. The following activities are expressly prohibited: reproduction, exhibition, transmission, distribution, and public communication, including making all or any part or content of the Application available on any other computer, server, physical or electronic support, web page, means of publication and\/or distribution without express written consent. \n <\/p>\n

\n The User agrees to respect all Intellectual and Industrial Property rights and to view the elements of the Application exclusively on the device on which it is installed, refraining from deleting, altering, evading, or manipulating the Application’s protection element or security system.\n <\/p>\n

\n \n ACCESS AND SECURITY OF THE APPLICATION\n <\/strong>\n <\/p>\n

\n The Application may only be used by those persons registered as Users, to use the Application, on behalf of the employer, by virtue of the software license and service provision Agreement formalised with the companies of our group. It is the User’s responsibility to maintain the confidentiality of their account information (User Code and PIN) and it is strictly forbidden to use another person’s account to access the Application.\n <\/p>\n

\n \n USE OF THE APPLICATION\n <\/strong>\n <\/p>\n

\n The Application provides access to a multitude of information, programmes, services, links, or data (hereinafter, the ‘Content’) belonging to the Owner. The User assumes full responsibility for their usage of the Application. \n <\/p>\n

\n Likewise, the User guarantees that all personal information provided through the Application is truthful and undertakes to keep his\/her data updated at all times. The User is solely responsible for the inaccuracy or falsity of the data provided through the Application and for any damages that this may cause to the Owner or third parties. \n <\/p>\n

\n The employment relationship between the User and the Employer serves as the legal basis for the Application to collect, report and notify all types of User information relating to employment such as: work shifts, holidays, absenteeism incidents, time off, distances and journeys, geolocation, messages, communications, documentation and personal data, among others.\n <\/p>\n

\n The User knows and accepts that the information may vary in real time, and expressly waives the right to make any claim against the Owner or third parties. Likewise, the User expressly accepts that the information communicated directly by his or her Employee will be specifically work-related, by the means stipulated by the Employer in accordance with the labour regulations in force. \n <\/p>\n

\n It is expressly forbidden to use the Application, or its Content, to carry out any activity contrary to the law or that may cause damage or harm to any person or property.  It is also strictly prohibited to use any process to access or monitor any part of the Application or its Content to obtain documents or information otherwise not available through the Application. Unauthorised access to any part of the Application, or to the services offered through the Application, by any illegitimate means, including the falsification or extraction of passwords, is expressly prohibited.\n <\/p>\n

\n It is also prohibited to assess the vulnerability of the Application, or any network connected to it, or to breach the security measures of the Application or any network connected to it, or to search for the data of other Users of the Application. \n <\/p>\n

\n By entering or accessing the Application, the User agrees not to carry out any action that could cause a disproportionate or unnecessary saturation in the infrastructure, systems and\/or networks connected to it, and not to use any device, program, virus, or routine with the aim of interfering with the correct functioning of the Application.\n <\/p>\n

\n A virus shall mean any computer application, code, file or malicious program that may prevent, impair or adversely affect the operation of any computer program, hardware or network, or any telecommunications service, equipment or network or device that may prevent, impair or adversely affect access to or the operation of any program or data, including the reliability of any program or data (whether by rearranging, altering or deleting the program or data in whole or in part, or otherwise); or adversely affect the User’s experience, including worms, Trojan horses, viruses and\/or similar devices.\n <\/p>\n

\n \n DISCLAIMER OF WARRANTIES AND LIABILITY\n <\/strong>\n <\/p>\n

\n The Contractor cannot guarantee that the information provided on the Application is free of incorrect or outdated information, technical inaccuracies, or typographical errors. The Contractor assumes no responsibility for the information provided by the Employer through the Application. \n <\/p>\n

\n Likewise, the Contractor shall not be liable in any case for damages of any nature arising from or related to the Application, the use or inability to use it, or that may be caused, including but not limited to, by errors or omissions in the Contents, the downloading or inability to download materials and contents, the total or partial unavailability of the Application or its contents, external links to other applications or web pages, the inaccuracy or lack of veracity of the data and information provided by and for the User, or the transmission of viruses or harmful programs in the content. This exclusion and disclaimer of liability applies to all causes of action, whether based on contract, warranty, tort or otherwise.\n <\/p>\n

\n The Proprietor disclaims any express or implied warranties, and the Proprietor cannot guarantee that the Application will be uninterrupted, timely, and error-free. The User therefore uses the Application at his own risk. All material, information, products, services, software, and programs are provided “AS IS”, without warranties of any kind.\n <\/p>\n

\n By accessing the Application, the User agrees to indemnify and not to sue or claim damages, expenses, or liabilities (including attorneys’ fees) of any kind from the Owner, the members of its management bodies, its agents, or employees, either on its own behalf or on behalf of any third party, for any reason whatsoever arising out of the use or inability to use the Application.\n <\/p>\n

\n \n LINKS\n <\/strong>\n <\/p>\n

\n Should the Application contains links or hyperlinks to other Internet sites and\/or applications, the Proprietor does not exercise any control over such sites and Content. In no event shall the Proprietor assume any responsibility for the availability or content of links to other websites or applications, nor guarantee the technical availability, quality, reliability, accuracy, comprehensiveness, accuracy, truthfulness, validity, legality and constitutionality of any material or information contained in any such hyperlinks, Internet sites or applications.\n <\/p>\n

\n \n RIGHT OF EXCLUSION\n <\/strong>\n <\/p>\n

\n The Owner reserves the right to deny or withdraw access to the Application and\/or the services and products offered therein, without prior notice, to those Users who do not comply with these General Conditions of Use.\n <\/p>\n

\n \n NON-COMPLIANCE WITH THE TERMS AND CONDITIONS OF USE\n <\/strong>\n <\/p>\n

\n In accordance with applicable law, the Owner may use the User’s personal data (including the User’s identity) for the purpose of conducting an investigation or complaint arising from fraudulent use of the Application, or to identify, contact or take legal action against someone who has interfered with or caused damage and\/or injury to the property rights of the Owner, the Employer or the Users of the Application.\n <\/p>\n

\n In the event that the Owner takes any legal action against the User resulting from the User’s breach of these Terms of Use, the Owner shall be entitled to be paid reasonable attorneys’ fees and costs by the User in connection with such action, in addition to any other remedies available to the Owner at law. The User accepts that the breach of these Terms of Use constitutes an unlawful and unfair practice, which causes serious damage to the Proprietor.\n <\/p>\n

\n \n MODIFICATION OF THESE TERMS AND CONDITIONS AND DURATION\n <\/strong>\n <\/p>\n

\n The Proprietor reserves the right to modify, add or remove parts of these Terms of Use at any time. It is the User’s responsibility to check these Terms of Use periodically for updates. Your continued use of the Application following the posting of any such modifications shall be deemed to constitute your acceptance of such modifications. \n <\/p>\n

\n \n COMMITMENT AND ACCEPTANCE OF THE TERMS AND CONDITIONS OF USE\n <\/strong>\n <\/p>\n

\n The User acknowledges having read and accepted the Terms of Use of the Application.
